Withdrawal – Cancellation – Return Procedure

Return Procedure: 

The service subject to this contract is within the scope of “Immediate services performed in electronic environment”. Therefore, the CONSUMER has no right of withdrawal in accordance with Article 15 of the Regulation on Distance Contracts published in the Official Gazette dated 27.11.2014 and numbered 29188. However, the CONSUMER knows and accepts that there is no right of return in accordance with the legal legislation for the stated reason. Despite this, Octopus knows and accepts that it offers the opportunity to request a refund in order to gain the satisfaction of its users, that this possibility can always be eliminated by Octopus and that each return request will be evaluated separately according to its nature. 

In this respect, in cases where the CONSUMER uses his right of withdrawal, or in cases where the product subject to the order cannot be supplied for various reasons, or in cases where it is decided to refund the CONSUMER with the decisions of the arbitral tribunal, the return procedure regarding the payment options is as follows: 

Return Procedure for Payment Options by Credit Card 

If the shopping is made with a credit card and in installments, the Bank makes the repayment to the CONSUMER in installments, no matter how many installments the CONSUMER bought the product.After the SELLER has paid the entire product price to the bank at once, in case the installment expenditures made from the Bank’s POS are returned to the CONSUMER’s credit card, the requested refund amounts are transferred by the Bank to the bearer’s accounts in installments so that the parties involved do not become victims. 

“If the refund date does not coincide with the credit card’s billing cycle, the amount of installment payments made by the CONSUMER until the cancellation of the sale will be refunded to the credit card account in installments of 1 (one) per month. The CONSUMER will receive the installment payments made before the refund after the sale’s installments have ended, for as many months as the number of installments paid before the refund, and these will be deducted from their current debts.” 

In the case of a return of goods and/or services purchased with a card, the SELLER cannot make a cash payment to the CONSUMER in accordance with the agreement between the SELLER and the Bank. When a return transaction occurs, the SELLER will make the refund through the relevant software, and since the SELLER is obliged to pay the relevant amount to the Bank by cash or setoff, as explained in the procedure above, cash payment cannot be. 

The refund to the credit card will be made by the Bank in accordance with the procedure above, after the SELLER makes a one-time payment to the Bank. The CONSUMER acknowledges and undertakes to have read and accepted this procedure. 

Refund Procedure for Bank Transfer/EFT Payment Options. 

The refund will be made via bank transfer and EFT to the account specified by the CONSUMER (which must be in the name of the person at the billing address or the name of the registered user), after requesting the bank account details from the CONSUMER.The SELLER will pay the full amount of the product to the bank in a single payment. 

In case of return of goods and/or services purchased through bank transfer/EFT, the SELLER cannot make cash payment to the CONSUMER according to the agreement made with the Bank. 

When a return process is initiated, the SELLER will make the refund through the relevant software and since the SELLER is obliged to pay the relevant amount to the bank in cash or by set-off, payment in cash to the CONSUMER cannot be made in accordance with the procedure described above. 

The CONSUMER acknowledges and agrees to have read and accepted this procedure. 

 
Return Procedure for Payment Options with Shopping Loan 

The refund will be made via bank transfer (havale/EFT) to the account specified by the CONSUMER (the account must be in the name of the person whose name appears on the invoice or in the name of the registered user). The SELLER will refund the full price of the product to the bank in a single payment. 

In case of a refund of goods or services purchased through credit, the SELLER cannot make a cash payment to the CONSUMER, in accordance with the contract between the SELLER and the Bank. In case of a refund, the SELLER will process it through the relevant software and is obligated to pay the relevant amount to the Bank in cash or by offsetting, therefore cash payments cannot be made to the CONSUMER in accordance with the procedure described above. The CONSUMER acknowledges and undertakes to have read and accepted this procedure.
